Requesting authorisation to export waste – transfrontier shipment of waste (TSW)

Summary

Are you a company intending to export your waste from Wallonia for recovery or incineration ? 

 A number of authorities will have to give an opinion on the transfrontier shipment that you intend to make : the authorities of dispatch, transit and destination of the waste

 In Belgium, each Region is competent for its territory in the field of waste. To ship and transport waste abroad, depending on the case (see below), it may be necessary to obtain authorisation from the various competent authorities. 

 In Wallonia, this is the Agriculture, Natural Resources and Environment (ARNE) of the Walloon Public Service (SPW), and in particular the Waste Management Infrastructure and Policy Department (DIGPD)

 

Why this tracking of waste ? To protect the environment and ensure the adequacy of transported waste treatment pathways. 

 

WHEN DO I NEED AN AUTHORISATION ? 

 When you cross the Belgian border, the term Transfrontier Shipment of Waste (TSW) is used. For shipments between Flanders and Wallonia, therefore, no request needs to be made. 

 

 Where shipments are not prohibited, there are two procedures : 

  1. SIMPLIFIED INFORMATION PROCEDURE 
    • only for waste recovery
    • only for waste on the ‘green list’ of waste (see Annex III of Regulation (EU) 1013/2006). They cannot be contaminated, hazardous, mixed (even with waste from this green list). 

You do not need prior authorisation from the authorities for this procedure. You should not contact our services. 

Your obligation is to complete the waste tracking forms. These documents may be required in the event of an inspection. See all the details in the ‘procedure’ section below. 

 

       2. PRIOR NOTIFICATION AND PRIOR CONSENT PROCEDURE FOR IMPORT, EXPORT AND TRANSIT AUTHORITIES 

  • For all other cases 

For example: 

  • mixed waste (even waste from the green list)
  • contaminated waste
  • hazardous waste
  • waste classified on the amber list (Annex IV of Regulation (EU) No 1013/2006: Axxxx or Rxxxx codes) even if they are not hazardous
  • waste not classified on the green or amber lists (even if not hazardous)
  • waste intended for disposal

In this case you need an authorisation to carry out your shipment. You must first request and complete a notification form (EUR 250) from the DIGPD. See the procedure below. 

Make your request well in advance: at least 2 months before the transport. 

 

The authorisation is valid for a maximum of 1 year. An exception is possible for certain destination facilities with specific authorisation (the period of validity may then be extended up to 3 years). 

 

WASTE IN TRANSIT 

 For waste that transits through our country and therefore one of the three Regions without stopping, contact the interregional transit authority, the Interregional Packaging Commission (IVCIE)

 

IMPORTING YOUR WASTE INTO WALLONIA: CONTACT THE AUTHORITY FROM WHICH THE WASTE ORIGINATED 

 Are you a foreign company intending to import waste into Wallonia in order to benefit from our infrastructure for waste recovery or incineration? 

 Contact the relevant administration in your country or region. It is the competent authority in the country of dispatch/origin of the waste that first examines the file. It then forwards it to our services to decide whether or not to authorise you to ship waste into Wallonia. 

 

EXPORTING OUTSIDE THE EU, OTHER QUESTIONS: CONTACT THE DIGPD 

 Do you want to ship waste outside the European Union? To find out the procedure to follow, contact our services because in many cases shipments are prohibited. 

 

OBLIGATIONS REGARDING THE WASTE CARRIER 

 As a reminder, the transport of waste is an activity subject to authorisation/registration, in accordance with the regulations of the countries or regions crossed.

Target audience – details

Companies intending to export waste from Belgium originating from Wallonia.

 

For example: 

  • companies that treat part of their waste in Wallonia but which due to lack of capacity cannot treat everything and therefore need to find alternatives abroad
  • companies producing waste for which there is no treatment facility in Wallonia

 

If you intend to import waste into Wallonia, you should contact the competent authority of the country/region of dispatch of the waste.

Conditions

REQUIREMENTS TO BE MET AFTER OBTAINING CONSENT 

Once the consents of the various authorities involved have been obtained, requirements must be met for each shipment made by completing the corresponding movement document : 

  • the notifier must comply with the pre-notification procedures : announcement of transport 3 working days in advance (Regulation 1013/2006 and OWG (Order of the Walloon Government) of 19 July 2007)
  • the destination facility and the consignee must comply with the post-notification procedures : written confirmation of receipt of the waste within 3 days and sending of the waste treatment certificates (Regulation and OWG of 19 July 2007).

Procedure

 1) INFORMATION PROCEDURE 

You do not need prior authorisation from the authorities to transport your waste. 

 

However, you will need the following documents

  • a tracking document (see the template in Annex VII to Regulation (EU) No 1013/2006) must accompany the shipment. This document must be duly completed and signed
  • a contract concluded between the person who arranges the shipment and the consignee in accordance with the requirements of Article 18 of Regulation (EU) No 1013/2006

Keep these documents for at least 5 years. 

 

2) NOTIFICATION PROCEDURE AND CONSENT 

The procedure can be carried out in French, German, Dutch or English

 

In stages 

  1. Administration fee (EUR 250) to obtain the notification form
  2. Preparation of the notification file (form and annexes)
  3. Analysis of the completeness of the file by the waste dispatch, transit and destination waste authorities
  4. Opinion and authorisation

 

ADMINISTRATION FEES (FEE) 

In Wallonia, the administration fee is : 

  • EUR 250 per notification form when issued by the Walloon Region, to be paid before requesting this form. Your bank transfer must indicate that it is a request for a numbered form and the email address to which the form to be completed must be sent
  • an amount calculated on the basis of the maximum number of transports provided for in the notification (box 4 of the notification) concerned multiplied by EUR 10, which must have been paid prior to obtaining the decision, by a transfer which must indicate the number of the notification concerned

Payment of these fees must be made by transfer to the account BE42 0910 1186 5654 of the Walloon Public Service, opened with BELFIUS BANQUE (BIC: GKCCBEBB). 

 

YOUR FILE : CONTENT AND TRACKING 

In order to be complete, your notification file must include

  • the notification form : request it by email to our services. The SPW assigns a number to each form in order to follow the files
  • all the required annexes, including :
    1. the contract with the waste recipient (recycler/disposer)
    2. the financial guarantee : you must provide us with a financial guarantee by sending an original duly signed by the guarantor :
      • either an original signed by hand (wet signature) by a proxy, which must be transmitted physically (a paper or digital copy is not sufficient)
      • or a digital original that has been digitally signed using a qualified signature (see in particular Regulation (EU) No 910/2014 on electronic identification) by an authorised representative, which must be sent electronically (a printed copy on paper is not sufficient). 

 

How to send the file? 

As an exporter, you should send your notification files to the DIGPD in as many copies as there are competent authorities

 

Postal address: Walloon Public Service, SPW ARNE, Soil and Waste Department, Avenue Prince de Liège 15, 5100 Jambes (NAMUR)

 

This allows us, as the exporting authority, to : 

  • forward the file with the original notification form to the importing authority
  • forward a copy of the file to each of the potential transit authorities
  • keep one copy of the file. 

 

We will acknowledge receipt of your request within approximately 3 to 5 weeks. Your file is then forwarded to the other authorities concerned. Following the analysis of the file and the receipt of the acknowledgement of receipt from the various authorities concerned, you will receive the decision within 20 to 30 days

 

APPEAL 

An appeal is possible before the Council of State.
