Obtaining authorisation to work as a road transport operator

Summary

The transport of individuals in vehicles with more than nine seats is subject to authorisation. Companies that provide regular, or specialised regular, transport services are required to obtain authorisation to work in this sector, in accordance with Regulation (EC) No. 1071/2009 and the Walloon Government Decree of 30 April 2009.

Conditions

Companies acting as road transport operators, or that wish to act as road transport operators, must satisfy four conditions:

  1. Establishment: the company must be established, in a stable and effective manner, within Wallonia.
  2. Good reputation: the transportation company or manager has not been convicted following a serious criminal offence, nor have they been sanctioned for one of the most serious offences with respect to Community regulations.
  3. Financial capacity:

the company must be able to demonstrate, based on its annual accounts, that it has capital and reserves of at least €9,000 each year for the first vehicle and €5,000 for each additional vehicle that it uses.

The company has a joint guarantee of at least €9,000 for the first vehicle and €5,000 for each additional vehicle that it uses.

Procedure

Companies must contact the Road Transport Regulation Department via email (see ‘Contacts’ section) or via post at the following address: Service public de Wallonie, Direction du transport de personnes, Boulevard du Nord, 8, 5000 Namur.

They must complete the application form to operate in this sector, as part of the provision of regular services or specialised regular services. Please note that, in order to be a road transport operator, four conditions must be satisfied. You can consult these conditions above.

If the conditions are satisfied, authorisation will be sent to the company bearing the signature of the relevant department.
